Administrative detention is typically imposed when the Göç İdaresi determines that a foreign national poses a flight risk, cannot be effectively monitored through less restrictive means, or when there are specific grounds that make deportation likely. The decision must be issued in writing and include the legal grounds for detention.
Grounds for Administrative Detention
Under Turkish law, administrative detention may be ordered when the foreign national:
- Poses a flight risk and is unlikely to appear for deportation voluntarily
- Has violated entry or exit regulations, including overstaying
