What Are Your Rights in a Removal Center in Turkey? Complete Guide

March 10, 2026 8 min read

Being detained in a removal center (Geri Gönderme Merkezi) in Turkey is a frightening experience, but you retain fundamental legal rights under both Turkish law and international human rights standards. Knowing and asserting these rights is essential for protecting yourself and challenging your detention. This guide explains your rights in Turkish removal centers.

Critical: You have the right to legal representation at all stages of detention. Contact an immigration lawyer immediately upon detention — early legal intervention significantly improves outcomes.

What Is a Removal Center in Turkey?

Removal centers are administrative detention facilities operated by the Directorate General of Migration Management under Law No. 6458. They hold foreign nationals who are subject to deportation proceedings while their cases are being processed. Unlike prisons, removal centers are administrative — not criminal — facilities, and detainees retain specific legal rights under Turkish and international law.

Your Fundamental Rights in a Removal Center

  • Right to be informed: You must be informed in writing, in a language you understand, of the reasons for your detention and deportation
  • Right to legal representation: You have the right to meet with a lawyer at any time, and legal consultations are confidential
  • Right to an interpreter: If you do not speak Turkish, you are entitled to interpretation services during all official proceedings
  • Right to contact your embassy/consulate: You can request that your country's diplomatic mission be notified of your detention
  • Right to communicate: You have the right to make phone calls and communicate with family members, your lawyer, and consular officials
  • Right to healthcare: Access to medical care including emergency treatment, ongoing medication, and mental health support
  • Right to humane treatment: Protection from torture, inhuman or degrading treatment under Turkish law and international conventions

Maximum Detention Periods

Administrative detention in removal centers is not indefinite. Under Article 57 of Law No. 6458, the maximum detention period is 6 months. This period may be extended for an additional 6 months (total 12 months maximum) only if the deportation cannot be completed due to the foreign national's lack of cooperation or failure to provide accurate information about their country of origin.

After the maximum 12-month period, you must be released. Continued detention beyond this period is unlawful and can be challenged through legal action. Your lawyer can file an urgent application for release if your detention exceeds the statutory maximum.

Healthcare Rights

Removal centers must provide access to healthcare services. This includes:

  • Initial medical examination upon admission
  • Emergency medical care at all times
  • Access to prescribed medications
  • Referral to external hospitals for specialized treatment when necessary
  • Mental health support and psychological services
  • Special care for pregnant women, children, elderly, and disabled persons

Right to Challenge Your Detention

You have the right to challenge the legality of your administrative detention before the Criminal Judgeship of Peace (Sulh Ceza Hakimliği). Your lawyer can file an application arguing that:

  • The detention is legally unfounded or disproportionate
  • There are no reasonable grounds for deportation
  • The detention period has exceeded statutory limits
  • Less restrictive alternatives (such as reporting requirements) should be applied instead
  • Your human rights are being violated by continued detention

Complaint Mechanisms

If your rights are being violated, you have several complaint mechanisms available. You can file complaints with the center administration, the Provincial Immigration Directorate, the Turkish Human Rights and Equality Institution, or through your lawyer to the Criminal Judgeship of Peace. International mechanisms including the European Court of Human Rights may also be available after exhausting domestic remedies.
